Experienced In Complex Adverse Possession Cases
When dealing with an adverse possession claim, you need an attorney who brings experience, knowledge and a track record of success. These cases are often complex and should not be trusted in the hands of a lesser-experienced attorney. When the lawyers at Vishnick McGovern Milizio LLP take an adverse possession case, clients immediately benefit from their comprehensive background in real estate law.
Adverse Possession Case Results
From residences to well-known commercial buildings in New York City, we have fought for and achieved rulings in favor of property owners. Some of our notable successes are outlined below:
- Successfully obtained title to a tract of land for a church in Manhattan. When the adjacent landowner’s property burned down, the church needed to fortify a party wall and built a wall of brick approximately two feet wide on the side of its building encroaching onto the neighbor’s property. Over 10 years went by before the neighbor complained and wanted the wall taken down. By demonstrating the church had maintained the wall in an open, adverse and notorious fashion for over 10 years, we were successful in forever ensuring quiet title to that piece of land which was formerly owned by the abutting landowner.
- Secured monetary damages on behalf of a client who was building a three-family home. When the neighbor placed cement and brick pavers on the walkway about six inches to a foot on the client’s property, our attorneys were successful in demonstrating the property was not lost through adverse possession — and the neighbor was in fact trespassing. This is one of the few and unusual adverse possession cases that actually went to trial and verdict.
- Defended a client in an adverse possession claim from an abutting landowner. With a few well-placed questions which were not anticipated by the abutting landowner, we were able to establish that the abutting landowner was coming onto the land and maintained the land with the permission of the landowner. Since the party was on the property with permission, the claim of adverse possession failed.
